Forms of payment are the derivative of the form of cooperation – approved with Client hourly rate, level of the case complexity, and estimated outlay of necessary work. In order to adopt to the needs of our Clients the Legal Office proposes the circle of possible to apply in practice manners of mutual settlements. Four basic forms are: 

Hourly rate

Applicable mostly towards the so-called typical orders, where this is possible to define precisely given for the realization of an order the outlay of work. The remuneration for the rendered legal services payable on the basis of approved hourly rate is a result of a product of hours devoted for the realization of an order/fraction orders and previously approved with the Client hourly rate. To such amount will be added VAT tax in the amount arising from the applicable provisions of law.

Clients before making the decision on the form of payments will be provided with information in the scope of possibility of choice hourly rate as the proposed manner of settlements and estimated outlay of work to realize the order.

Lump sum with the limit of hours

Arising from the title of rendered legal services constituted by complex, current legal support of Client there exists the possibility of establishment of the remuneration in the form of a lump sum with the limit of hours.

Assuming that, the total number of hours for the particular month will be constant, the settlement will be done subsequently to the fee fixed on the monthly basis. In case where the approved limit will be exceeded, to the amount of remuneration fixed as the lump sum over the limit of the approved on the general basis financial settlement will be added the value of outlay of work according to the hourly rate.

Lump sum without the limit of hours

The form of financial settlements applicable usually for entrepreneurs, public institutions, rarely for individuals. The system of lump sum remuneration without limit of hours will be done as the stipulation in the agrement on legal support monthly remuneration arising from the tile of rendered legal services constituted of complex legal service of a Client.

The amount of monthly remuneration will be the subject to negotiation and is dependable from many factors: the size of the company, kind of rendered activity, level of complexity of the entrepreneur, chosen form of cooperation ( there is a possibility of in-house legal service i.e. permanent legal service of the entrepreneur in the seat of company under service), estimated quantity of cases ordered on monthly basis, etc.

Lump sum plus success fee

As we notice various needs of our Clients, the Office of the Legal Advisor Joanna Szanser-Smagacz offers the cooperation in legal support for the certain investment process or developer project. In case where this form of cooperation will be chosen the rules of financial settlement will be stipulated individually in the course of negotiation. The amount of remuneration will be the derivate of level of complexity of on-going or planned administrative proceedings, planned value of the investment, level of responsibility for conducted activities, multitude and level of existing risks, estimated time of legal service, etc.
